Domain: Shadhi.com – Wipo Case No. D2014-0932 -August 11, 2014

Complainant is an Indian company owner of several trademarks and domain names consisting in the SHAADI word, requesting the transfer of the SHADHI.COM domain name before the WIPO domain name dispute resolution service. The WIPO Panelist rejected the complaint sharing Respondent’s (represented by Roberto Manno – WebLegal) submissions with regard to: lack of identicality/confusing similarity between the trademark (being a common famility name in India) and the domain name (consisting in a generic and descriptive Indian word meaning “wedding”); fair use of the domain name within the vanity email service business model; and – moreover – lack of any proof on Respondent’s bad faith in the registration/use of the domain name.

Il ricorrente, azienda indiana titolare di vari asset sulla denominazione SHAADI (domini – marchi), chiede il trasferimento del dominio SHADHI.COM. L’arbitro WIPO, accogliendo i rilievi formulati dal resistente (rappresentato dall’Avv. Roberto Manno – WebLegal), respinge il ricorso affermando che: non v’è identità o confondibilità tra il marchio e il dominio contestato, trattandosi di una parola generica e descrittiva la prima (“matrimonio” in lingua indiana) mentre la seconda è un nome patronimico molto diffuso in India; è stato dimostrato l’uso legittimo del dominio per la fornitura di servizi di vanity mail services; e – sopratutto – il ricorrente non ha fornito alcuna prova della malafede da parte del resistente nella registrazione e/o uso del dominio.
